Overview

A tenant that won't pay or won't adhere to the lease is a problem. A tenant that won't go away is worse. The attorneys of McBrayer, represent commercial landlords in lease disputes. We help clients efficiently resolve disputes or cut their losses and clear the way for new tenants.

Our clients include owners and operators of office buildings, shopping centers, medical facilities, industrial space, apartment buildings, and other commercial or multi-family properties in Kentucky and surrounding states. We commonly represent out-of-state owners or local property management companies that need our industry experience in negotiations and litigation.

Representing Commercial Landlords In Tenant Disputes

Our real estate attorneys and trial lawyers have extensive experience with commercial lease disputes:

  • Defaults in payment — We can pursue eviction if the goal is to get rid of a problem tenant. We can also pursue workouts or renegotiation of the lease if our client wants to continue the relationship with an otherwise good tenant who is currently in arrears.
  • Judgments and liens — Contested lease disputes may involve litigation over secured interests. We purse liens against the tenant's inventory, fixtures, or other assets or sureties. We have experience with Article 9 (UCC) secured transaction litigation.
  • Use disputes — We can pursue eviction or injunctive relief if a tenant is making unauthorized renovations, creating a nuisance for other tenants or otherwise acting inconsistent with the lease provisions.
  • Change of ownership — When properties change hands, the new owners may need to renegotiate the terms of the lease and the tenants may balk. We facilitate subordination agreements to get new financing, and we represent buyers or sellers in negotiating extensions or new leases.
