Overview
McBrayer’s interdisciplinary and collaborative team of Data Privacy, Security, and Technology (DPST) attorneys provide pragmatic, risk-based and timely advice to our clients focusing on emerging threats, regulations, judicial decisions and revolutionary technologies. Much like our clients, our DPST team is up to speed and tech-forward, working with highly regulated industries like medical research, pharmaceuticals, and energy.
Privacy Compliance
Our team provides our clients with full spectrum, globally coordinated advice and proactively addresses compliance needs against the rapidly-changing regulatory and threat environment. We are there for our clients at each phase as they develop and operationalize privacy compliance programs. We also design and roll out new technologies, develop comprehensive privacy policies, ensure appropriate cybersecurity and privacy due diligence, and create and negotiate data transfer and use agreements.
Our attorneys are intuitively experienced at performing gap and data assessments, coordinating technical consultant services, insurance policy analysis and negotiation, policy crafting, creating vendor management programs, training, service provider negotiation, and transaction due diligence.
We are particularly adept at counseling clients on their risks and obligations under laws relevant to their data, including, the European Union’s General Data Protection Regulation (“GDPR”) (and the United Kingdom’s equivalent), the California Consumer Privacy Act (“CCPA”), the California Privacy Rights Act (“CPRA”), and numerous other state and industry-specific data protection laws.
Data Breach Response
We also work closely with clients to prepare for cybersecurity incidents, including data breach response planning and training, insurer coordination, and pre-incident service provider engagement.
Emerging Technologies
We advise on the privacy implications of new technologies like artificial intelligence.
Cross-Disciplinary Collaboration
Our DPST team is often called upon to identify potential conflicts between data privacy and intellectual property rights, such as when personal data is embedded within protected technology. And importantly, we help clients navigate their legal and regulatory requirements while minimizing business disruption.
Keeping up to speed on the latest developments is as important to us as it is to our clients, and our DPST team remains actively involved in professional organizations related to data privacy and security, such as the International Association of Privacy Professionals.
