One of the side-effects of current alcohol regulations in many states is the failure of state regulation to completely pre-empt the field with respect to ABC law. This leads to a dizzying array of inconsistent and often incompatible regulations that affect multi-jurisdictional entities such as large retailers. One area where this is particularly egregious is server and clerk training, which can be mandatory, encouraged or thoroughly ignored, depending on the local jurisdiction. This patchwork of inconsistent regulation can lead to significant pitfalls for the unwary alcohol retailer -is the only panacea state-wide regulation? This presentation will discuss the practical challenges for the hospitality industry in states such as Kentucky, where training for servers and clerks is not mandatory at the state level.
