Since its initial formulation in Parker v. Brown, 317 U.S. 341 (1943), the state action doctrine has been the subject of approximately fifteen Supreme Court decisions and hundreds of decisions by the lower federal courts. The doctrine is well described in the ABA Section of Antitrust Law's Anitrust Law Developments (Fourth). This practice manual incorporates the teachings of that treatise and expands on practical issues that confront antitrust practitioners in the application of the doctrine.
